These Buyers and Users Terms and Conditions ("Terms") govern the use of Legacy Gallery ("Platform"). By registering and using our Platform, the Buyer and all Users agrees to comply with these Terms.

1. Eligibility

  • To use Legacy Gallery, you must be at least 18 years old and capable of entering into legally binding agreements. By registering, you represent and warrant that you meet these requirements.

2. Registration and Account

•Account Creation: To participate in auctions, you must create an account. You agree to provide accurate and complete information during the registration process.

Verification: Legacy Gallery may request additional information or documentation to verify the identity and legitimacy of Sellers. Legacy Gallery reserves the right to approve or deny any Seller application at its sole discretion.

•Account Security: You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized use of your account.

•Account Termination: Legacy Gallery reserves the right to suspend or terminate accounts at its discretion, without notice, for any reason, including violation of these Terms.

3. Payment

•Accepted Payment Methods: Legacy Gallery accepts major credit cards, and other payment methods as specified on our website.

•Payment Security: Transactions are processed through secure payment gateways to protect your information.

•Payment Disputes: Any disputes regarding payments should be directed to our customer support team for resolution.

4. Item Descriptions and Condition

•Descriptions: Legacy Gallery strives to provide accurate descriptions and images of items. However, we do not guarantee that descriptions are error-free.

•Condition: Items are sold "as-is." We encourage Customers to inspect items in person if possible or request additional information before bidding.

5. Shipping and Delivery

•Shipping Arrangements: Legacy is responsible for arranging the shipping of each sold item in the platform, either through auction or sale.

•Delivery Time: Delivery times may vary based on the shipping method and destination. Legacy Gallery may be liable for the delays caused by shipping providers, but that is highly dependent on the case analysis.

•Risk of Loss: The risk of loss or damage passes to the Customer upon delivery of the item in the final destination address, particularly after the POD ( Proof of Delivery) is signed, considering this document doesn’t report any damages.

•Timely Shipping: Legacy Gallery is responsible for shipping of the sold Items promptly and within the agreed timeframe.

•Tracking Information: Legacy Gallery is entitled to provide Buyers with tracking information for shipped Items to enable them to monitor delivery status.

•Packaging: Sellers must ensure that Items are securely packaged to prevent damage during transit.

•Insurance:Legacy Gallery is responsible for insuring Items during shipment to cover potential loss or damage.

6. Import/Export Restrictions

•Some Items may need special permits for export from the country where they are based and/or import into the Buyer’s country. In some situations the item may also be subject to a a special permit or right of the country from which they are exported to purchase the Items from the Buyer. The Buyer is informed that Legacy Gallery doesn’t s offer any warranty or shall have any liability to the Buyer in respect of the requirement for, or the availability, or issuance of valid export or import permits or the existence or exercise of preemption rights to purchase by governmental or regulatory authorities anywhere.

•If the Buyer first learns that the listing of any Item in Legacy Gallery requires special export or import permit after the Item has been picked up by the shipper, and Legacy Gallery is unable to obtain or help to obtain the export permit within thirty (30) days after the later of confirmation of the sale or disclosure of the requirement for the export permit, then the Buyer may rescind the purchase of such Item by giving written notice to Legacy Gallery.

7. Taxes and Duties.

•The Buyer is entirely responsible for paying all applicable sales and use taxes, VAT, export and/or import taxes and duties and all transactional taxes or levies related to each Item purchased (collectively, “Taxes”).

•The Buyer shall pay such taxes, typically through a local Import Agent, but failure of the local agent to collect those Taxes will not relieve the Buyer’s obligation neither will make Legacy Gallery or the Seller responsible for those taxes.

•In the event that an exemption applies, it is the Buyer’s sole responsibility to establish and/or document any applicable exemption from Taxes

8. Returns and Refunds

•Due EU Consumer Rights Directive (2011/83/EU) as implemented into national law in all EU jurisdictions, applies to a consumer based in the European Union (“EU Consumer”), where in these Terms, the EU Consumer has the right to cancel its order without giving reason within 14 days from the day on which the EU Consumer or its designated recipient receives an Item (“Cancellation Period”).

•The EU Consumer must inform Legacy Gallery, or the Seller, of its decision to cancel the order in writing (including by email) within this period. Legacy Gallery will then refund all payments received from the EU Consumer for the Items purchased and the EU Consumer shall incur no fee as a result of such refund.

•Any refund may be withheld until the Seller has received the Items back from the EU Consumer. The EU Consumer must send back the Item following the instructions of the Seller (but in all cases the EU Consumer will be given at least fourteen (14) days to return the Item from the date of cancellation), and the EU Consumer will be required to bear the cost of returning any Item to the Seller.

•Legacy Gallery may make a deduction from the refund for loss in value of the Item returned due to the EU Consumer’s handling of the Items beyond what is necessary to establish the nature, characteristics and functioning of the Item. No restocking fees will be applied to refunds under this subsection.

•The right of cancellation does not apply to: (A) the supply of any Item made to the Buyer’s specifications; (B) the supply of any Item which may deteriorate or expire rapidly; (C) the delivery of any Item which is not suitable for return due to health protection or hygienic reasons if unsealed by the Buyer after delivery, or which are, after delivery, mixed inseparably (according to their nature) with other items; (D)

•To exercise this right of cancellation, an EU Consumer must send written notice during the Cancellation Period to Legacy Gallery Customer Support, with the subject line “EU Consumer Rights.” The notice should state the name, residential address, contact details and email address, Legacy Gallery account number, Order number, Item Number, date of delivery to your possession.

•The same Return Consumer Right doesn’t apply to any other customer outside the EU, and hence, each Sale is final, unless certain conditions apply.

•Damage Claims: If an item arrives damaged, Customers must report the damage within 48 hours of delivery. Legacy Gallery will assist in resolving the issue with the shipping provider.

9. User Conduct

•Prohibited Activities: Users agree not to engage in any activities that violate laws, infringe on intellectual property rights, or disrupt the functionality of Legacy Gallery's services.

•Content Submission: Users may submit content such as reviews or questions. By doing so, you grant Legacy Gallery a non-exclusive, royalty-free license to use, modify, and display this content.

10. Disputes Resolution

•In the event of a dispute between Users, Legacy Gallery encourages both parties to communicate and resolve the issue amicably. If a resolution cannot be reached, Legacy Gallery may, at its discretion, offer mediation services.

•Legacy Gallery reserves the right to make final decisions on disputes, which will be binding on both parties.

11. Binding Arbitration

Any disputes arising out of or relating to these Terms or the use of Legacy Gallery's services that cannot be resolved through mediation will be resolved by binding arbitration, conducted in accordance with the rules of UK Law.

12. Intellectual Property

12.1 Ownership

All content and materials on Legacy Gallery, including text, images, logos, and software, are the property of either Legacy Gallery or its licensors and are protected by intellectual property laws.

12.2 License

Legacy Gallery grants all Users and Buyers a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes, in accordance with these Terms.

13. Privacy and Data Protection

13.1 Privacy Policy

Legacy Gallery's collection, use, and disclosure of personal information are governed by Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your personal information as described in the Privacy Policy.

13.2 Data Security

Legacy Gallery employs reasonable security measures to protect all users and Buyers personal information.

14. Termination

14.1 Termination by Users

All users may terminate their Legacy Gallery account at any time by contacting Legacy Gallery customer support. Upon termination, you will no longer have access to your account or any associated content.

14.2 Termination by Legacy Gallery

Legacy Gallery reserves the right to suspend or terminate all Users and Sellers account and access to the platform at any time, for any reason, including but not limited to violations of these Terms or suspicious activity.

14.3 Modifications to the Terms

Legacy Gallery reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the platform. Your continued use of the services after the posting of changes constitutes your acceptance of the modified Terms.

15. Limitation of Liability

To the fullest extent permitted by law, Legacy Gallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

•The use or inability to use the platform.

•Any conduct or content of any third party on the platform.

•Any content obtained from the platform.

•Unauthorized access, use, or alteration of your transmissions or content

16. Indemnification

All users agree to indemnify and hold harmless Legacy Gallery and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the platform, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

17. Governing Law

These Terms and any disputes arising out of or related to them will be governed by the laws of the UK

18. Miscellaneous

18.1 Entire Agreement

These Terms constitute the entire agreement between you and Legacy Gallery with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Legacy Gallery to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18.4 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.

20. Arbitration

Any dispute, controversy, or claim arising out of or relating to this Terms and Conditions or the breach, termination, or validity thereof shall be settled by arbitration administered by UK governing law.

The arbitration shall be conducted under UK’s governing law, and the language of the arbitration shall be English.

The decision of the arbitrator shall be final and binding upon the parties and may be enforced in any court of competent jurisdiction.

21. Miscellaneous

•This Terms and Conditions does not constitute the entire agreement between the parties with respect to the subject matter hereof and doesn’t supersedes all prior agreements and understandings, whether written or oral, but it guides the nature of the relationship of both parties.

•This Terms and Conditions may be amended or modified only by a written consent signed by both parties.
